Octeract Cloud services terms of use

These terms govern the use of any service on the Octeract Cloud, including Octeract Neural. By agreeing to these terms, you also agree to our general Terms And Conditions.

This service is provided on an “AS IS” basis. It is intended for demo purposes for products still in development. Use of this service for any legal purpose is permitted, subject to the terms outlined below.

License to Use

You are granted a non-exclusive, non-transferable, revocable license to use our service for any legal purpose, acknowledging its demo status and limitations.

User Obligations

Indemnification: You agree to indemnify us against all legal and financial liabilities, excluding those mandatorily imposed by law, and to cover our legal expenses arising from your misuse of the service.

Account Limitation: Each user may maintain only one account. Attempts to create multiple accounts or use bots for circumventing usage limits will result in a ban. We reserve the right to terminate or deny access at our absolute discretion without notice.

Service Availability

Given the service’s developmental nature, we do not guarantee uninterrupted access or error-free performance.

Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email. Your continued use of the service signifies acceptance of the updated terms. It is your responsibility to stay informed about any changes.

Limitation of Liability

The service is provided without warranties of any kind, either express or implied. We shall not be liable for any damages arising from your use of the service.

Competitive Restriction

This service is not available for use by direct competitors of Octeract Limited or any entity that is engaged in the development, production, marketing, or distribution of similar products or services. Use of this service, including all related functionalities and data, by competitors for any purpose, including but not limited to benchmarking, design, development, or competitive analysis, is strictly prohibited. This restriction specifically includes all entities who develop, sell, or distribute optimisation solvers of any kind.

Governing Law

These terms are governed by the laws of England and Wales, without regard to conflict of law principles.
